Al-Mikhlafi: courts to protect human rights underway

Almasdaronline- Sanaa: Minister of legal affairs Dr Mohammed Al-Mikhlafi said on Thursday they are discussing with the government two agreements for formation of a human rights court and another to protect people from forced disappearance before referring them to the parliament.

In the fifth conference on social justice which was organised by the council of the revolutionary youth at its Sanaa headquarters, he put the spotlight on mechanisms and measures aimed at preventing the repeat of conflicts through institutional reforms, forming an independent human rights commission and commitment of the government to international human rights accords.

He brought up four elements related to transitional justice and that were establishing accountability for past human rights violations, law of criminal and reparation justice, preserving the national memory to honour martyrs and victims and preventing the repeat of crimes and human rights violations.

In a paper titled "transitional justice and foreign role to draft its law" which was presented to the conference, Dr Jamil Hifzuallah highlighted foundations with which transitional justice can face past human rights violations including holding civil and criminal trials, investigating and exposing violations, reparation of victims, institutional reform, building memorials and reconciliation.

"Accumulated administrative failure, democracy retreat, scarcity and misdistribution of resources and fragile state institutions and civil society have made Yemen an attractive place for foreign meddling," he said.

In another paper, lawyer Munir Al-Sakaf highlighted basic standards of transitional justice such as principles of the work and formation of real reconciliation committees, establishing the principle of accountability, reparation and judicial, security and law reforms.

Al-Sakaf stressed the importance of creating a good democratic atmosphere, drafting a new constitution, providing real education based on democratic values and activating and strengthening the role of the civil society.

He reviewed a number of transitional justice types from different countries that Yemen should learn from.

Spokesperson for the council talked in the conference saying transitional justice is the essence of the peaceful youth revolution to take the country into democracy.

Political commentator Abdulbari Tahir, Murad Dhafir and representatives of the causes of Tahama, Saada, south and middle regions attended the conference.
